General Conditions of Sale
Art. 1 - General Provisions
1.1. The user, by browsing this area, accesses www.rosadoro.net, accessible via the URI: www.rosadoro.net (hereinafter referred to as "https://www.rosadoro.net"). Browsing and submitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site itself, as indicated therein.
1.2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 as amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by

1.3. The user is required, before accessing the products provided by the site, to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
1.4. The user is invited to download and print a copy of the purchase form and these General Conditions
of Sale, the terms of which www.rosadoro.net reserves the right to modify unilaterally and without prior notice.
1.5. It is possible to use the site and therefore access products provided by it and purchase them in the following languages:

Art. 2 - Subject
2.1. These General Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on www.rosadoro.net and do not, however, govern the provision of services or the sale of products by parties other than the seller who are present on the same site via links, banners or other hypertext links.
2.2. Before placing orders and purchasing products and services from other parties, we suggest checking their terms and conditions of sale.
Art. 3 - Conclusion of the contract
3.1. To conclude the purchase contract, it will be necessary to fill out the electronic form and submit it following the relevant instructions.
3.2. It contains a reference to the General Conditions of Sale, images of each product and its price, the payment methods that can be used, the methods of delivery of the purchased products and the relative shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; methods and times for returning purchased products.
3.3. Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale, including the Information on the right of withdrawal and the processing of personal data.
3.4. The contract is concluded when the seller receives the form completed by the user, after verifying the correctness of the data contained therein.
3.5. The user will be obliged to pay the price from the moment the online order submission procedure is completed. This will happen by clicking on the "buy now" button at the end of the guided procedure.
3.6. Once the contract is concluded, the seller takes charge of the order for its execution.
Art. 4 - Registered users
4.1. By completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.
4.2. Once registered, the user will receive a confirmation email to the email address provided. The
confirmation must be communicated within one day at most. After this period, in the absence of
confirmation, www.rosadoro.net will be released from any commitment towards the user. v
4.3. Confirmation will in any case exempt www.rosadoro.net from any responsibility regarding the data provided by the user. The user undertakes to promptly inform www.rosadoro.net of any changes to their data communicated at any time.
4.4. Furthermore, if the user communicates inaccurate or incomplete data or even in the event of a dispute by interested parties regarding payments made, www.rosadoro.net will have the right not to activate or to suspend the service until the relative shortcomings are remedied.
4.5. On the occasion of the first request for activation of a profile by the user, www.rosadoro.net will assign the user a username and password. The latter acknowledges that these identifiers constitute the system for validating the user's access to the Services and the only system suitable for identifying the user, and that acts performed through such access will be attributed to him and will have binding effect on him.
4.6. The user undertakes to keep their access data secret and to guard them with due care and diligence and not to transfer them even temporarily to third parties.
Art. 5 - Product availability
5.1. Product availability refers to actual availability at the time the user places the order. This availability must in any case be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products could be sold to other customers before order confirmation.
5.2. Even after the order confirmation email has been sent, cases of partial or total unavailability of goods may occur. In this event, the order will be automatically rectified by eliminating the unavailable product and the user will be immediately informed via e-mail.
5.3. If the user requests cancellation of the order, thereby terminating the contract, www.rosadoro.net will refund the amount paid within 7 working days from the moment www.rosadoro.net became aware of the buyer's decision to terminate the contract.

Art. 7 - Payment methods and prices
7.1. The price of the products will be that indicated from time to time on the site, unless there is a clear error.
7.2. In case of error, www.rosadoro.net will notify the buyer as soon as possible, allowing them to confirm the order at the correct amount or cancel it. In any case, www.rosadoro.net will not be obliged to supply what was sold at the erroneously indicated lower price.
7.3. The prices on the site include VAT. Prices may change at any time. Changes do not affect orders for which an order confirmation has already been sent.
7.4. Shipping costs will be paid separately by the user and will vary based on the user's cart. The user will always be informed of the shipping cost at checkout.
7.5. Once the desired products and services have been selected, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the requested information at each step of the process. Order details can be modified before payment.
7.6. Payment can be made by credit/debit card. Payment details must be entered at the time of order using a valid credit or debit card, such as Visa, Mastercard and American Express. The amount will be debited immediately, and www.rosadoro.net reserves the right to
verify the validity of the card and its solvency status. Following the checks, www.rosadoro.net reserves the right to refuse the order.
7.7. In case of payment with PayPal, www.rosadoro.net reserves the right to verify the validity of the PayPal account, to verify that there are sufficient funds to cover the amount of the purchase and to confirm the correctness of the buyer's billing address details. The amount will be debited immediately from the PayPal account, but you will not be charged anything until the items leave the warehouse. www.rosadoro.net reserves the right to refuse any order.

Art. 8 - Delivery
8.1. www.rosadoro.net ships throughout Italy, excluding the Vatican City State and the Republic of San Marino. Delivery will not be made to the following territories: _
8.2. www.rosadoro.net will make its deliveries both to the address provided by the user and to the collection points indicated at the time of purchase.
8.3. Delivery is generally made within the following period: or, if no delivery date is specified, within the estimated time at the time of selecting the delivery method and, in any case, within a maximum of thirty days from the date of confirmation.
8.4. If delivery is not possible, the order will be sent to the warehouse. In such an event, a notice will specify the location of the order and how to arrange a new delivery.
8.5. If you are unable to be at the delivery location at the agreed time, we ask you to contact us again to arrange a new delivery date.
8.6. If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we will assume that the contract is intended to be terminated.
8.7. As a result of the termination, the amounts will be refunded, including delivery costs with the exclusion of any additional costs deriving from the choice of a delivery method other than the ordinary method offered without undue delay and, in any case, within 7 working days from the date of termination of the contract. The transport resulting from the termination of the contract may have additional costs which will be borne by the
buyer.
Art. 11 - Withdrawal
11.1. In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days pursuant to art. 52 of Legislative Decree 206/2005 starting from the date of receipt of the products.
11.2. In the case of multiple purchases made by the buyer with a single order and delivered separately, the
30-day period runs from the date of receipt of the last product.
11.3. The user who intends to exercise the right of withdrawal from the purchase can do so by accessing the section: "www.rosadoro.net/recesso" on the www.rosadoro.net website by creating a return request.
11.4. The user can also send an email, indicating the order number and their name, to the following email address:

11.5. The buyer must also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or, alternatively, by transmitting the standard withdrawal form, referred to in Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.
11.6. The goods can be returned to any sales or collection point located in Italy, as indicated on the website at the time of purchase.
11.7. The goods must be returned intact, in their original packaging, complete with all their parts and complete with the attached fiscal documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum of 7 working days and any shipping costs incurred by the user.
11.8. The costs of return will be borne by www.rosadoro.net.
11.9. As provided by art. 56, paragraph 3 of Legislative Decree 206/2005, modified by Legislative Decree 21/2014, the site may suspend the refund until receipt of the goods or until the buyer has demonstrated that they have returned the goods.
11.10. The right of withdrawal will not apply if the services and products of www.rosadoro.net are included in the categories of art. 59 of Legislative Decree 206/2005.

11.11. The site will issue the refund using the same payment method chosen by the buyer during the purchase phase. In the case of payment made by bank transfer, and if the user intends to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT and BIC necessary for the refund to be made.
Art. 12 - Data processing
12.1. The buyer's data are processed in accordance with the provisions of the personal data protection legislation, as specified in the specific section containing the information pursuant to art. 13 EU Regulation 2016/679 (Privacy Policy).
Art. 13 - Safeguard Clause
13.1. In the event that one of the clauses of these General Conditions of Sale is null and void for any reason, this will in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

Art. 15 - Applicable Law and Jurisdiction
15.1. These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any different overriding mandatory rule of the buyer's usual country of residence. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law.
15.2. Any disputes inherent in and/or arising from them must be resolved exclusively by the Italian judicial authority. In particular, if the user qualifies as a Consumer, any disputes must be resolved by the court of the place of their domicile or residence based on the applicable law.
